Proposed Legislation To Prevent Renters From Smoking In Apartments

SACRAMENTO, CALIFORNIA — A new smoking ban is in the works that could make it illegal to smoke in your own apartment.

New legislation is being proposed by democratic senator Alex Padilla of Van Nuys that would allow, not require landlords to ban smoking inside their rental units.

The Rental Association of Sacramento Valley supports the legislation and has already mailed out thousands of informational leaflets to apartment complexes in the Sacramento area.

Cory Koehler Deputy Director of the Renters Housing Association discussed benefits of the legislation, " there's the reduced costs, reduced cleaning cost, reduction of fire danger to the property and really a healthy living environment for other residents."

Some renters like Enrique Rojas disagree with the proposed legislation, " that law doesn't make any sense at this point, I understand bars maybe they should ban it in bars but not in your own apartment. I don't believe that's right."

The smoke-free housing bill has been read in the committee and unlike similar bills that have been proposed in the past, housing experts say this has a better chance of passing because it is not mandated and up to each landlord to ban smoking or not.

I need some advice. I am actively trying to quit smoking and, until 2 days ago, had not had a cigarette in four months. I moved into a nonsmoking building and have never smoked in any apartment I have rented. Long story short, I fell off the wagon and had a cigarette down the street from my apartment. My landlord saw me, called me a liar, and evicted me on the spot, posting an actual 30-day eviction notice on my door within an hour. Again, I HAVE NEVER SMOKED IN MY APARTMENT OR WITHIN 100 FEET OF THE BUILDING.

I tried to talk to him, apologize and ask for a second chance. He became more abrasive and threatened to put me on some landlord watch list so no one would ever rent to me. I live in Portland, Ore. Is this legal?

I'm going to move regardless because the guy is obviously unstable. But do I have any recourse? Should I file a complaint with someone just in case this landlord tries to make trouble for me?

I live in a Retirment community it is a self care facility where we take care of ourselves there is 100 of us in the building i live in and we each maintain our own apartments here they are taking away our rights to smoke in our own apartments. This has added undo stress we will as of 8/1/09 have to go 50 foot from the building to smoke I feel this to be unfair and unsafe I been looking for help on this issue but i been finding there is little help available what Is so wrong about this is they say since they cut our rent to our income and give us a break makes it a government building and they have the right to do so.Yet i have worked all my life since i was 15 i am 71 years old now I paid my dues.They act as though they are offering a service that I did not pay for.Maybe for the ones that are not retired and are given these things maybe they have the right to act that way but as I said i paid my dues why should they be able to come into my place and say I can no longer smoke in my own home.If anyone can tell me what I can do to stop this injustified infringment on my personal rights please let me know thank you so much

Pretend it's smoke from a joint or barbecue and go join them.Better yet,move to Greenland and don't burn anything.

I have a neighbor below me that smokes and I can smell the smoke everytime he lights up. What should be done is that there should be non and smoking in a complex building so all the smokers are together and all the non smokers don't have to smell it. That way you can smoke in your house and I don't have to smell it if its in another building.

I always thought that smoking/nonsmoking was up to the owner. Why should there be a law?
