Hello - I'm looking for advice about re-sending cigarettes to NYC:
I live in Massachusetts. Is it illegal for me to ship cigarettes to a friend who lives in New York City buys online (or over the phone) and has sent to my MA address? No profit for me; just a favor for a friend.
Would I be breaking any laws by doing this?
If this is currently legal, does anyone know of any pending legislation that might make it illegal?

| I think you can mail cigs as long as you don't sell them, but you may want to ask a lawyer about that ... |

| My understanding is that New York has stopped private carriers like UPS and FedEx from delivering cigarettes in New York State but they can't stop the US Postal Service. The Postal Service will ship tobacco throughout the country since their federal status trumps New York's proscription. In fact I think some Indian sources still ship directly to New York customers but simply no longer give them shipping options. They only ship USPS to New York. That's my impression anyway. I doubt very much you'd have any problem mailing cigarettes to New York. You're not supposed to sell cigarettes without a vendor's license. You're not selling. It's a favor. A gift. |

Only the town with the most bars per square mile than any other town in the United States! Hoboken is actually only one square mile, it's the last town in NJ before the Holland Tunnel to NYC. There are literally hundreds of bars, almost one on every corner. It is truly a paradise on earth. It's also the birthplace of Frank Sinatra and Baseball. |

| That sounds like a cool place. Can you smoke in the bars or do you have to go stand outside, 20 feet from the door? Do they stay open all night or do they close at 2 AM like they do in S. California (the "S" isn't for "Southern," it stands for "Socialist"). |
