In my opinion, You should talk to the lawyer about this situation. In this case everything will be clear. Actually, it was expectable that everybody whose sigs were seized at JFK would get such letter. As for me in that letter authority just wants to bring to your attention about the forfeiture of your property. And They give everybody a "chance" to get the cigs back using 2 options which are mentioned in the letter, however it seems imposible to do that. |

Did They mention about certain penalties in that letter? |

The body of the letter says:
On 11/25/2004 at JFK Airport, Jamaica, NY 11405, the property described above was seized for forfeiture by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). The Property was used or acquired in violation of CCTA, Cigarettes (18 USC 3051 (c), 19USC ss 1602-1618 and 18 USC ss 983.
You may contest the seizure and forfeiture of the subject property in United States District Court by filing a claim, or you may consent to the forfeiture of the property through the administrative process and seek equitable relief from the forfeiture by filing a Petition for Remission or Mitigation of Forfeiture. |

I'm so nervous I copied the first paragraph wrong. I should say:
The property was used or acquired in violation of CCTA, Cigarettes (18 USC Section 2344) Administrative forfeiture proceedings have commenced in accordance with the provisions of 18 USC 3051 (c), 19 USC ss 1602-1618 and 18 USC ss 983. |

It sounds to me like they have been seized at customs. I dont really know much about this yet, but, my opinion is that they are telling you that if you want your smokes you will not get them. The word "foreiture" tells me that you are going to "forfeit" your smokes. I may all be legal mumbo jumbo for "we got your smokes and are going to destroy them, have a nice day, US Customs"
Did they mention any specific penalties? |

| Do nothing. The cigs will be destroyed by the ATF. End of story. Same goes for anything else illegal/taxable that comes in from overseas. If you dont claim it (i.e. do one of the 2 things they noted in the letter), you really dont have much to worry about. |

How many of your cartons do They have?
I guess those people have to worry who ordered hundreds cartons at once.
Did they mention any specific penalties? |

They gota total of 4 cartons packed in 2 separate packages.
The didn't mention any penalties. |

Mr/Ms Guest,
You say "There is nothing to worry about" with a degree of authority, just wondering if that is a qualified legal decree or your opinion.
Having read some of the articles from the November seizure there was some punitive threats made to send names to the respective states involved and I am not so self assured that won't happen given they have names and addresses of those involved. |
