I found out today that a resident in a nursing home, approx. 83 years old was given a 30 day order to move out of a facility because he was outside smoking. The medical facility, hospital and long tern care unit have a no-smoking policy. The crux however is that employees go outside to smoke and to date no discipline has taken place for them. The elderly gentleman lives in the facility with his wife and it sure screams discrimination to me. Does anyone have any legal advice or know of someone who may have? Thanks!

First thing to do is get a hold of the media and have them run a story - preferably TV....then newspaper.

Yup. if the facility is no smoking and you going outside to smoke is a no no, it should also be a no no for the workers to do the same.
