| I live in Ohio and it has recently come to my attention that a hospital in the area tests for nicotine!!! I find this absurd, testing like for an illegal drug, when nicotine is perfectly legal. I find it insulting and was wondering if it is even legal to do this???!!!??? Thanks! |

Apparently, unless specifically named in the anti-discrimination laws, it is perfectly legal to discriminate. |

Yep, in Ohio it's not specifically listed on their anti-discrimination laws. However it might be able to be argued under the disability of addiction but it hasn't been challenged yet ttbomk. |

Creepy you mentioned the hospital you worked at tests for nicotine, Shrpsh. However, I'm not totally surprised, given that hospitals usually are among the most anti-smoking of any businesses one could work for.
Not to mention, virtually all hospitals nowadays have those BS '100% smoke-free outdoor campus' rules! |

| It's not crude enough that where talking about banning smoking at hospital, and such, My work, I dont even work for pfizer directly, but yet, the rules apply to me. But pfiser is banning all smoking, even in your cars on jan 01, '09. I am not only upset about this, I think it's wrong. The company owns miles of land around it's pharmasutical plant, and we only get 15 minutes verses the real employee's of pfizer, they get 20. Our company hasnt done, or said anything to help us, in fact our company doesnt care. It's not bad enough that the company (pfizer) seems to be near dier straits with laying off thousands of people from it's once blooming plant, but now they are trying to run our lives. Even if I didnt smoke, I would be upset. (this same company is huge on heathly living, but offers junk food in vending machines... but then again, that makes them money, giving enjoyment to there hardworking contract workers doent!) All I can say is this company is going to lose a good number of hardworking people, and oh yes, MICHIGAN SUCKS! |

As I have posted before, you do not have a right to smoke. All of our legit legal arguments have to do with property rights, not the right to smoke.
Most state are hire and fire at will, so yes they can not hire you or fire you for smoking.
So just go work for someone else. It is not like that company is the only job you can get. They have a right to hire the employees they want and you have the freedom to sell your services to any company or organization that you like. |

tell me again how they test for nicotine? Do I remember something about cotinine levels? Can't you tell them you just ate a bunch of potatoes? Am I wrong here? Thank goodness, I work somewhere that they respect my professional abilities, not what I do in my private life or the parking lot at work...  |
