| I am a smoker and think it is really ignorant for smoking and non smoking sections to exist in the same room without ventilation or filtering. I worked in HVAC and it would cost the average establishment less than 10 grand at building time to provide adaquate ventilation. But, they would rather jump on the nonsmoking band wagon and screw our rights. Like the right to not freeze to death and get an ear infection in the middle of the winter. If you want to blame someone for second hand smoke blame the people who set up these buildings or the people who buy them and are not willing to pay the extra money. I will smoke inside when the weather is a risk to my health and hell with anyone who disagrees. Where i work they provide a heated enclosed area for smokers. I do like the concept, however by bunching us all together our exposure to second hand smoke is like 10 times worse than it would have been. I also wanted to add - have you every driven by a black top or tar plant and almost passed out from the fumes. Thats got to be as bad as being exposed to hundreds of cigarettes worth of second hand smoke - why doesn't these smoker haters go after these places to install a filter or something, probably because they are just full of politically correct BS. |

| I guess it depends on the state as to why or why not they go after factories. In NJ, we have more bans and regulations on factories than on smokers. Groups are constantly complaining about factory smoke, and those poor factory owners are facing hell in the garden state. I hope they keep the spolight on factories in NJ, and maybe we'll never have a smoking ban like our neighbors in NY. |

If the bar and restaurants owners would only take this nonsense to court since their business is most affected, this stupidity wouldn't spread as quickly as it does. Why Bars/Restaurants haven't launched a Class Action Lawsuit is incomprehensible. Smoking Bans seriously affect business, sometimes to the point of bankruptcy. Surely, compensation for damages are in order.
Adequate ventilation should be in every bar and restaurant regardless whether smoking or non-smoking.
If more smokers stood up for the "right not to get soaked or freeze", like non-smokers, and took this to court with a Class Action Lawsuit, they would most likely win by claiming forcible exclusion leading directly to unnecessary exposure to weather detrimental to health. |
