Maybe someone can help me define "premises".
Local business in Harrisburg, PA went to a "Smoke-Free Environment". A memo was issued at work stating that "smoking will no longer be permitted on the premises. Violation of policy will result in disciplinary action."
An employee was seen smoking outside the property after this new rule went into effect the following week. To clarify, the employee was smoking on a public sidewalk outside of company's fenced parking lot. The employee was told that he was being sent home, without pay for the rest of the day and was given a disciplinary write up the following morning. The employee disagreed with the action taken and believed that the action against him was unjust. The incident occurred while the employee was off the clock during a lunch hour.
I am interested to hear any thoughts on the matter. |

Possibly the co thought they own the sidewalk too - are they responsible for clearing the side walks of snow - they could have a point, or rather, they could make the point...
Face it - they don't want to see smoking by their employees - time to walk around the block - take the car out of the parking lot, etc.
There are co's that are firing people for smoking when they aren't even at work [look up Scott's Miracle Grow - by the way - spring is coming- don't forget to boycott them]

With respect to the connection in N. KY increase in visitors, many of them are comming from Ohio and Indiana spending their money. How difficult is that to understand?
You can still smoke in public there.......I've been there myself as well as about 50 other people who frequent N. KY every other weekend or so. We stay at hotels, eat out, go to b ars etc etc.
I don't get it, I thought we were all in here for the purpose of educating and fighting the fight to keep our most basic freedoms! If you're still confused let me know, and I will make another attempt to explain expanded volumes of people showing up for no foreseen reason.
N. KY loves us right now. |

It is the property owner's responsibility to keep those sidewalks clear of snow and ice, etc.
If the city need to widen any adjacent roads they would either remove or adjust the sidewalk area to suit their project needs under the "right away".
If the co decided to remove the sidewalk, I'm sure the city would have something to say about that.
What about other non-employees that walk that sidewalk enjoying their cigs? There isn't any action against them. Seems unfair.

It is unfair, but nothing is fair in this world. Right now the health-freaks and environmentalist-wackos are running the joint an others are getting on the bandwagon.
It's apparently fun to mess with others' lives and livelihood.
In comparison to what is being done to smokers nowadays this is child's-play to keep the employees out of the sight of the employer and customers. If this person has access to a car, drive off the property and smoke, if not - walk around the block...or find a hideaway location to enjoy the break - there's got to be somewhere.

Company is Non-Union.
Maybe its about time that it should be.

I was just asking about a Union because most union contracts have every little detail spelled out and you can technically fight it if they forget to write in every little detail.
i.e. - how can you be written up for an infraction that's not spelled out in the contract.
As to Unions as a whole, they probably won't protect smokers rights and could make them worse for smokers

I have been in N. KY every day since the NCAA Tourney started hanging out at Tickets Sports Bar in Covington, KY eating drinking and smoking big fat cigars. You should see all the Ohio plates on cars parked over there. There are not many KY plates in downtown Cincy. |
