i recently received a bill for over 3000$ from the drs for online cig purchases made from 2005-2007 i wonder why they waited 2 years allowing all those penalties and charges too accrue I am willing too dispute this and am looking for advice from others in the same situation and how they handled it and outcome by the way FYI too all those buying from smartsmoker.com you can be sure too receive a simular bill from your state taxing authority as this site has reported everyone that has made purchases regardless of amounts I order the 3 carton min beware of this site and stop doing buisness with them..... |

Yickes Mike, that's a big tax bill....
I have no words of wisdom and have not heard of anyone winning except for hardship cases with payment plans and the scattering of a few reductions...
All I can say is write them back and ask them to prove it in detail.
Search this site for other avenues that have been posted.
Consult a lawyer
For the future, you have some choices:
Pay for CT cigarettes
Quit
Blackmarket -I don't think it's strong in CT
Buy RYO/MYO tobacco - lots cheaper-and better
Please stay away from internet sources, they will probably catch up to others sooner or later

| Actually, there HAVE been a few instances in some states where the fines got overturned, but damned if I can think of where right now. Ands there was one state where an incoming governor negated all fines for this. |

Also, just thought, call Jim Vicevich on WTIC 1080 am Radio 10 am-12
Can also e-mail him your plight, he may have you call him on his show, at least call in and get the word out.
He talks about smokers rights [he's a smoker] and all Nanny state stuff.
They do listen to him in the government.

Thank you all for your responses, I do plan on calling and writing letters I just emailed wtic and hopefully will get a response to see if they want to air this story ..The drs has allready sent the itemized list for every single purchase from smartsmoker from 2005 untill dec2007 I also made a purchase earlier this month b4 i became aware of this travesty.
my main complaint is the drs could and should have immediatly sent those bills from the 2005-2006 tax year out that same year that is why I am appealing this and disagreeing with the drs
they only give 45 days for a reduced amount and that has too be paid in full about 1750$ i plan on calling the radio staion as well i dont thing smokers should be penalized for being consumer wise with these outragous fees etc the drs web sight for forms the form is called au75 Tax Return for Persons in Possession of Unstamped Cigarettes fees as follows. this is a very long list but shows all fees applied and targets smokers as i dont see these surcharges on any other type of online purchase anywres other then having too pay sales tax which is 6%
Conn. Gen. Stat. §12-316 imposes a cigarette tax on the storage or usewithin Connecticut of any unstamped cigarettes in the possession of anyperson other than a licensed cigarette distributor, or licensed cigarettedealer, or a carrier for transit from outside Connecticut to a licensedcigarette distributor or licensed cigarette dealer in Connecticut.Unstamped cigarettes are cigarettes in packages that do not bearstamps evidencing payment of the Connecticut cigarette tax. Under Conn.Gen. Stat. §12-320, the cigarette tax does not apply, and you need not file
this return, if you bring no more than 200 cigarettes intoConnecticut onyour person or in accompanying baggage.

I am writing this letter to you, because I just received a tax bill for cigarette purchases made online. from the Ct Drs. The Ct Drs has billed me with penalties and interest from the 2005-2007 tax years. I think these charges are outrageous, unfair, and I strongly disagree with them, I only have 45 days too pay a reduced amount but even this amount is unfair and I am also unable to come up with that money as well. I Disagree because the Drs waited for over (2) years before sending me this bill allowing these penalties too accrue. I also was not aware of the fact that online cigarette purchases were subject too additional fees, taxes, and penalties for being consumer wise and going to somewhere that I could afford to purchase cigarettes. I would be happy too pay Ct sales tax of 6% on any purchases made online, however I cannot afford too pay higher fees and taxes for being consumer wise and a smoker. Mrs. Rell I don't see additional penalties for buying other goods or services online so why are smokers being unfairly targeted with these fees?
I only hope that you can overturn these fees and penalties in the form of tax rebates to all those who received these particular bills, as I am sure it is not only causing me a hardship as well as a hardship too all other smokers who purchased online. At a time of facing a national recession
now is not the time too target smokers.

Please do keep us informed.
I listen to Vicevich a lot, hope to hear you on the airways, he's a powerful voice in CT.
Hopefully Jodi Rell will listen, review and change the discriminating tactics.
The government always talks about the 'level playing field'....well, going only after the tobacco tax on internet sales is BS...they want to tax, then tax all internet sales - they won't touch that with a ten foot pole - would ruin commerce...just pick on a minority of society.
We should call for a level playing field. |

| I agree they would never do that. As for now I roll my own untill this is resolved. As far as im concerned they harass and discriminate agaisnt smokers not only in Ct but most other states as well and I do hope my letter changes this states views on smokers, and hopefully other states will follow. It really is up too the smokers to fight too keep the rights are forefathers ancestors etc had. As far as paying are taxes for online purchases I would have no problems doing that if it was fairly taxed like any other goods or services purchased online. I do hope too her from Jim as well although my work schedule conflicts with his air time. I have not received any response from wtic or the governor yet. Will update as things change. Peace |
