I just read everyone's thoughts. Thanks for all your support... I smoke outside because I have a little child in here and we live in a very small apartment.
So far, I've checked with my other neighbors and no one else has a problem except the two sets of problem tenants who both happen to live near me.
I have since been sent a letter from the financial co. who owns the building saying I have to smoke indoors and if I don't, they will consider makeing this a smoke free building (which would take at least a year or so and they may even have to grandfather people out). Thing is.... I am THE ONLY smoker in the buiding who received this letter - just me...
At this point, I have resolved to keep on keeping on and if they give me anymore problems, I WILL get a restraining order.
But what I would really liike to know, is the law  |

The law is ever-changing and in many cases, usually against the smoker.

And start reading

Quit
Hide the Activity
Move
Fight back legally and set precedence

I don't think you are ever going to find any law that protects you as a smoker. That is just the way it is in this imperfect America.
I can tell you what I would do if I were in exactly your circumstances.
I would get a Philippino friend (and it shouldn't be that hard to find one in LA) to get me some fish they call "TUYO"
I would fry some on the patio bar-b-que everyday. I suspect that soon you might be in a barganing position with those complaining neighbors along the lines of: which do you hate to smell the worse...my smoking or my fish. 
In this PC world you might just have a chance at defending your cooking of tuyo if you argue it is culturally linked. I suspect after a few days of smelling cooking tuyo they will readily agree to stop whining about the patio smoking.
PS...my wife who is Filippina is allowed to cook tuyo with her friends in our home on occassion...provide she tells me in advance so I can open all the windows and leave the house for a day. The smell is brutal and potent. I don't understand how they can eat it but they do seem to love the stuff and I am a tolerant person within reason. |

Junge is right - there aren't too many laws, if any, which protect the smoker. Set the precedent. |

The extremist anti-smoking laws that are more and more blowing beyond California, and into other parts of the world, especially Canada and an increasing amount of other areas within America(especially since it isn't just a blue state trend to adopt anti-smoker laws anymore, as red states are increasingly jumping on the nanny state bandwagon)., are absolutely scary beyond belief.
That said, I don't think it's surprising that I've seen increasing signs of this crap starting to more and more hit the Chicagoland area(though at least certain symptoms of this crap haven't hit here yet, i.e. apartment smoking bans, outdoor sidewalk Calabasas-like bans, etc.). Especially since several Lake Michigan communities have banned smoking on beaches in just the recent year(starting w/Muskegon(MI) + Ottawa County, Michigan, and this crap very recently occurring in suburban Lake Forest and Wilmette, and just 1 month ago, Chicago). Though lol, I still smoke on Chicago beaches anyway, and efff anti-smoking groups for using the 'litter' excuse to pressure the Chi. Park District into passing a beach ban.
Back to the subject matter, I suspiciously wonder if the landlord of his apt. building was targeting Caron alone, especially since it seems like from his/her posts that there were a few other smokers also living in that apartment complex, and not just him/her. I hope you succeed in getting those neighbors to leave you alone and let you smoke on your patio in peace, even if you have to get a restraining order against those 2 fools in court. |

You don't have to be from the Phillipines to cook nasty smelling fish either...You could cook Lutefisk (scandinavian delicacy, whitefish preserved in lye)...nasty stuff! But edible.

First off let me say, Heaven help the person who tries to confront me for smoking on my own property, be it leased or owned. What I do in my home, as long as its legal, is NO ONE's concern but my own.
I have a hard time understanding this no smoking out in the open air bs anyway. Jesus, just move out of the draft if its drifting your way.
All these anti fanatics are really pissing me off. I've gotten to the point of not caring or being a "considerate" smoker anymore just to prove "I can" and don't care what they think. It's time we all started fighting for our rights.
Reading this makes my blood boil. I wish I lived next door to you, believe me, I'd make em hate life for doing that. |
