Cigarette Taxes, Black Markets, and Crime Lessons from New York’s 50-Year Losing Battle Read PDF
All the laws state confiscated and seized contraband cigarettes are to be destroyed. The reality is the cigarettes are being distributed and resold to prison inmates. I am outraged and demand an accounting.
Thats Right... the Feds and the States each have their own internal cigarette distribution monopoly and racket pimpin inmates!!!
The Blackmarket for cigarettes in prisons is unbelievable:
$10 per cigarette / $200 per pack. Ever wonder why the smoking ban is not enforced in prisons? Ever wonder how inmates get cigarettes? Certain corrupt officials are profiting directly and get this... they are even charging the govt a disposal fee!
This is rackateering at the highest levels and total bullshit.

TTB Federal Statutes
§ 41.25 Disposal of forfeited, condemned, and abandoned tobacco products and cigarette papers and tubes.
When any Federal, State, or local officer having custody of forfeited, condemned, or abandoned tobacco products or cigarette papers or tubes, upon which the Federal tax has not been paid, is of the opinion that the sale thereof will not bring a price equal to the tax due and payable thereon, and the expenses incident to the sale thereof, he shall not sell, nor cause to be sold, such articles for consumption in the United States. Where the articles are not sold, the officer may deliver them to a Federal or State hospital or institution...
From NY Statutes from FindLaw
S 1846. Seizure and forfeiture of cigarettes.--(a) [i]Whenever a police officer designated in section 1.20 of the criminal procedure law or a peace officer designated in subdivision four of section 2.10 of such law, acting pursuant to his special duties, shall discover any cigarettes subject to tax provided by article twenty of this chapter, and upon which the tax has not been paid or the stamps not affixed as required by such article, they are hereby authorized and empowered forthwith to seize and take possession of such cigarettes, together with any vending machine or receptacle in which they are held for sale....
(c) In the alternative, if the tax commission concludes that any cigarettes seized pursuant to this section, when offered at public sale, will bring a price less than the reasonably estimated price which the department of correctional services would have to pay for the purchase of such cigarettes for sale to or use by inmates in institutions under the jurisdiction of such department, the tax commission may dispose of such cigarettes by transferring them to the department of correctional services for sale to or use by inmates in such institutions. |
