You should check on this - Costco knows your home address and if they have to report you you may be required to pay BOTH SC and NY taxes on any cigarettes you purchase out of state.


I'm not an attorney but my read is

This is the 1949 Jenkins Act and it appears to only apply to delivery sales of cigarettes into other states. It does not appear to apply to Retail / Pickup orders.

I would suspect this law is only in play if Costco ships cigarettes for delivery across state lines. Specifically they could not charge SC sales tax and would have to physically ship the cigarettes and indicate on their invoice the order was delivered in NYC. I would not be able to pickup the order in South Carolina if this were a delivery sale.

I am convinced this really simple order method is no loop hole at all but a legitimate retail sale for merchandise ordered and paid for in advance for customer pickup.

What I decide to do with my property once picked up is really no ones business as I am not in the cigarette business.

I certainly admire your ingenuity on this deal and I'm sure the delivery will be made but make no mistake about it....

The gov't and the antis will make it their business if and when they find out! This is taking money out of their pockets.....ill-gotten as it is on their part. And we're talking about TOBACCO here. It's practically a 4-letter word in the public's brainwashed eye nowadays.

I'm also pretty certain you'll be over the limit as far as how many packs of cigarettes can be possessed in NY without a NY tax stamp regardless of point-of-sale or how they got into NY.

Trust me.....the gov't creates lots and lots of laws so that everyone can ALWAYS be found in violation of something if it suits their purposes. They feel they can't effectively rule over a law-abiding populace.

The anti-smoking Taliban in the US have probably already bombarded every anti-smoking group in their newly acquired non-smoking Country,the US of A,to quash every sale that is not personally picked up by the buyer.Costco is first on their list.

On a lighter note,how do we get rid of the intolerants among us?

I order from Seneca Direct and pay by electronic debit, but found out that under the Patriot Act, the government can and does access your bank records without telling you about it. Guess I can expect a tax bill eventually Confused

Used to order from OT Direct, but they raised the prices. What exactly was the story of this guy that ran OT Direct? Is there something I have to worry about?

Might want to check out RYO. If you can find a local supplier it eliminates the tax problem.
