Hi all,
Well as you can see from my user name i'm one of those who have managed after many years of trying and failing managed to quit and stay quit for 6 months now. the decision to quit was my own and for no other reason than finacial,yes i did enjoy a smoke.

However I still have many friends and colleagues who are smokers and I respect them for it and do not have any other oppinion on their smoking habbits, My employer has just relocated to new premisis and has imposed a total smoking ban on site yes including out in the car park etc.

At first my friends and colleagues would stand at the front of the building at coffee breaks and smoke off site but now a ban on leaving site during coffee breaks has been imposed, surley banning smoking and not providing a smoking area or catering for the smokers is a breach of civil rights is it not.........your thoughts and oppinions welcome

Hi ashkicker,

I guess what I am wondering is this: is the property the employer's to begin with, or is it a shared office complex? If it is shared by other employer's your employer has no right to dictate to everyone. If, however, it is your employer's office complex, then I suppose they have the right to do as they please (as unfortunate as that is).

I am wondering how they can or are enforcing the ban on leaving the premises during a break. It is a break, so unless the employees are on the clock, they should be free to do what they choose on their break (drink coffee, smoke cigarettes, go to mail a letter, etc...).

What keeps employees from crossing the street to smoke a cigarette? Surely there are not guards and a huge gate keeping the employees from leaving the premises.

Best of luck to your fellow employees!!!!!! It's getting tough for a smoker to enjoy his/her pleasureable habit.

You should check into some of the English workers rights laws. I know Britain has more workers rights than we do over here, so maybe they have something to protect the workers freedom of chioce also. Good luck.
