Bill, I am currently wondering how the good hard-working folks of New York (and NYC) will be able to purchase their cigs online after Wed. 18th.
According to this article it will be illegal to do so. Which, if you really think about it, NY will still lose money because those who can't purchase over the net can always go to soverign land and stock up there.
I am not a New Yorker, but I'll be damned if crappy legislation like this infiltrates the rest of the country!!!!

I'm not quite sure of this, but it may work.....
The website I consulted said it could still ship to out of state PO boxes. Now, I've never had a po box, so I'm not sure how it works (if you need documentation that you live in the state to rent one or not).
I do know this much about it: A friend of mine had a PO box in Massachussets and he'd moved to Louisiana to finish his education. He had all his stuff from his PO box forwarded to Louisiana.
There are 2 possible ways to circumvent the new law (though they are both a pain in the ass, but still save you money depending on how much you smoke and where you order from).
Option 1) Drive to somewhere that has an Indian reservation and/or low cig. tax and purchase there and bring home.
Option 2) Get a PO box out of state and have your cigs. forwarded from that po box address.
How do you save?
($7.50/pack * # of packs smoked) - (cost of where you purchase from * number of packs) - gas, tolls, etc. to do the initial renting of P.O. box = $$$ saved.
I hope these two solutions help out somewhat  |

This was supposed to have taken effect a while ago, but it's impossible to enforce. Yesmoke.com (and I'm sure quite a few others) are still shipping to NY. They can't go through your mail, so they will never know. The foriegn distributors like Yesmoke don't care about laws like these so it's really a non-issue. But it is total BS that the gov't is once again trying to control us - now it's the mail they are trying to control.
When will smokers AND non-smokers alike wake up to realize if they can take freedoms like this away from us, they can take anything away from us. We are being censored, controlled and lied to by the gov't., and that's not just a smoking issue - that's an issue every one of us should care about. |

| Bill, you are right, it was supposed to take effect in May. However it had been pushed back to June. |

| I don't think it matters when it's going into effect - people are still going to have shipments come to them. They can't check the mail, it's almost impossible. I've even heard of quite a few people who have drugs shipped to them in the mail because it can't be searched. |

Actually, there is another way to sidestep the law if the internet sellers want to do so (specifically Native Americans, and us-based retailers:
Rent a P.O. Box and have no identifying marks (including company name) on the packages that say it's cigarettes or anything of the like.
I think that NY's endevour to try and stamp out online sales will end up costing them more in the long run (both from MSA payments b/c the Senaca's that sell cigarettes boost the legitimate sales of cigs which in turn boosts the MSA payments from the tobacco companies ---- MSA pmts. are based on volume of sales from grocery, convenience, and yes sites that are run by soverign nations the soverign nations order directly from the companies themself), it will also end up being an enforcement nightmare.
This will hopefully give NY and other states the clue: lower the damned taxes!!!!! |
