I took a closer look at my "Invoice" NJ sent me from esmokes. It states the sales tax portion is based in part on the purchace price of NEW JERSEY STATE MINIMUM AVERAGE RETAIL PRICES at $34.68 per carton. My bill was $173.40 for 5 cartons. I checked esmokes web page today and checked the prices for what they said I had bought and the price was $85.05 for the subtotal! I also noticed that i supposedly oreded Basic Ultralight Menthol 100's. Problem is, I DON"T SMOKE MENTHOLS! I sent an email to esmokes asking for a copy of my invoices, but I don't realisticly expect them to reply. I also called them but got a fast busy signal. I am now in the process of writing the NJ Tax Dept and informing them of these errors and demand a copy of the invoice esmokes sent them.

you know you can log into Esmokes.com if you still have your login/password, go to "Order History" and print out the invoice for each calendar year.

I ordered from them from about 8/04 to 2/05, about 22 cartons total during that time. I just received a bill for $467.00 for those cigarettes from esmokes. I was ordering because in NY all you could get were those awful tasting fire-proofed cigarettes. I didn't do much background on esmokes, I just assumed they were operating under a Sovereign Territory. A big expensive mistake. They sold me out real quick obviously, those bastards. I've been warning people away from them ever since.

I saw that they charged me the state minimum on the NJ tax bill. I was actually paying 29.99 a carton for most of the time I was ordering. I did the math on how much less I'd pay in total if I recalculated with the actual cost instead of the amount they indicated. And honestly it barely makes a difference. The amount after redoing the excise+actual amount at 6% is so small it's not even worth the copies I'd have to make to prove what I actually paid. But that might be a different story for people with $1000+ tax bills.

I haven't ordered online since Feb. 2005 and they still came after me for this. I've been stuffing my own ever since and never looked back. Stopped smoking those chemical laden cigs and switched over to American Spirit. I actually enjoy cigarettes now, whereas before it was all just a bad addiction. Regardless, in the end I am paying ALL the taxes I thought I was avoiding by buying online and actually now am paying extra for whatever I laid out for shipping all those times. It sucks and really just annoys the hell out of me the method the tax authorities went about this. We are the essence of taxation witout representation, all these anti-smoking folks who feel the need to proselytize on this website cannot deny that fact. Regardless of what they feel about smoking, if you look at the situation the smokers are put through it really is nuts.

Thanks for the tip, mines $1,000+. It seems I can shave off $35 or so. All my orders are doubled in price. I logged into Esmokes, but can't get to the 2003 orders, so I'll have to do some more digging, at least I got 1/2 the orders.

Same here. My order is from 2003 also.

They're assholes. I can't believe their site is still up there. I think some people took my warnings in 2003 on here. I sure wish more did. We knew this would happen. E-Smokes got too big. I'm just cures for anyone that got those tax bills, does NJ subtract the KY excise tax so you only owe about $23.70+ 6% sales/carton, or do they double tax you. Just curious if anyone knows. I think if they didn't subtract the KY 30cents (at the time) per carton, it's technically illegal.

I will be sure to include that in my letter to NJ State.

I am SO PO'D!!! $1560 bill from the state of NJ received on 3/7 due on 3/30 for purchaces made from 2003 and 2004. If they are going to demand this money with no actual invoices backing them up in their letter - Can't they even give me 30 days to pay this??? And there figures are WRONG!!!!! And this stupid company ESMOKES is still in business???

If I got a tax bill like most from NJ,I would contact a tax attorney in NJ to fight the unfair taxation or settle with State for pennies on the dollar.

I think an attorney will cost more then our taxes due. If I had the bucks, I would check into it. Even if it is "legal" for them, it's still bullying, something the credit card companies are not allowed to do. Has anybody dealt with NJ and done any payment plans. I was basically told, to write a letter proposing a payment plan of 3 equal installments, and include the first payment for good faith. I told them on the phone I was back to square one, and no way could come up with 350. Same for me, Friday night, the 3rd, I received mine with the same deadline. I made the call on Monday.
I was hoping to do 100/month, even that will be rough. I won't even be able to send that out until the 17th as my husband gets paid every 2 weeks.

You basically get [doodee] for answers over the phone, do it in writing is their standard reply.
