I go to a bar to drink. And smoke. People who are allergic to dogs should not become veterinarians. People who don't like cigarette smoke should not become bartenders in smoky bars. There never was a law requiring smoking in bars. There never was a law requiring bar owners even to permit smoking in a bar. Bar owners are free to ban smoking just as they were free to require the wearing of a necktie in their bars years ago. Then people choose. Do I wanna wear a tie? Do I wanna smoke? Go to the kind of place you want. Directly inhaling dozens of cigarettes a day every day for decades gives you a ten per cent chance of getting lung cancer. Second hand smoke is a hilariously trivial health concern, until you crack a window, leaving nothing to laugh at. That's the plain truth. The health nannies are fanatical alarmists. Loud music damages hearing. That's the plain truth. I suppose the health nannies could claim soft music also damages hearing. So let's ban music. Come on. Let's put an end to this. FREEDOM MEANS BAR OWNERS AND CUSTOMERS CHOOSE. BLOOMBERG & COMPANY MEANS THE TALIBAN. Bar owners: IGNORE THIS TERRIBLE BAN!

Now that's what I'm fucking talking about! FUCK THE NAZI FASCISTS WHO TRY TO CONTROL OUR FREE WILL!

American citizens should have the right to do whatever they want. No seatbelt? Fuck it. The insurance companies shouldn't be allowed to put pressure on the gov't to enact legislation which penalizes me for opting to not wear my seatbelt. That's my choice, not theirs.

In the same fashion, bar owners should be free to make up their own mind as to whether or not their establishment allows smoking.

Luckily, there is such a protest right now the ban is likely to be overthrown shortly, but I can't believe they ever got away with it!

Actually, there is a law on the books in Louisiana where motorcyclists can choose whether or not they want to wear their helmets.

I think that's way more risky than smoking, because if you get into an accident, you'd be a vegetable.

At least our legislature does recognize freedom of choice (or at least it did on this issue).

A batter stands in the batters box and takes a 95mph pitch in the head.

A quarterback drops back to pass and is blidsided by a 300 lbs lineman and driven into the dirt.

A Nascar driver is rearended, sending him into a wall at 180mph.

A non-smoker walks into a Bar that allows smoking.

The first three happen, no arrest, no public fines, no criminal record.

The 4th one happens and BOOM.

Self determination is a GOOD thing, AND IT, like no other RIGHT is under severe attack.

Texas also has that helmet law. Funny how a person on a bike is free to choose while a person driving a car is fined for not 'protecting themselves'.

So true. In fact, you would have to go to a smoky, unventilated bar twenty times and spend about six hours there each of those twenty times to "inhale" the equivalent of ONE cigarette. At this rate, it would take approximately 8111 years to develop a 10% chance of getting lung cancer.
The notion that just being around a smoker is a health hazard is as ridiculous as saying that if you are downwind of your neighbor cooking hamburgers on his grill, your cholesterol will go up.

I'm surprised a large group of smokers, combined with bartenders and other bar employees (all from NY state) haven't filed a lawsuit against Bloombnerd of NYC....who's an ex-smoker, although I hear he smokes cigars.

The way I see it, if people are SO d@#n tired of the NY smoking bans, maybe you should DO something about it instead of mentioning it on a smoking site. I seriously doubt NY state governors/reps and Bloombnerd are all reading this site. It's time to hit them where it hurts....in their wallets. Sue them. That's what I'd do. They claim these bans are for the workers' health and non-smokers' health.

There's PLENTY of evidence going against Bloombnerd's possible claim of "If we allowed smoking, the workers' health and other people's health would all be affected." As you said yourself, 2nd hand smoke is trivial BS from antis. So that means Bloomnerd and NYC/NY State should be sued and cough up MILLIONS of $$$ to the NY smokers for basing smoking bans on LIES!!

That's what I'm talking about!!! I saw on the news Sunday night that cig. shops in France are closing for a day to protest their $1.50 increase in cig. taxes. I say that it's high-time US tobacco merchants do the same god-damned thing!!!

New York did a no lotto protest for a couple of days. Remember that no smoking, no lottery campaign. I haven't been to the city since the smoking ban. It would just upset me, so I stay away. The only way that I see a large protest working is if a few strong powerful people stand up and get a big following, because we're going up against organized crime all over the city as well as Mayor Bloomberg. It would take a strong powerful force to fight these 2 large powers. I would love to see it done, but I don't want to die for smokers rights.
