Yep. $2,600 due March 15. ESmokes claims they did not release info, and claim that the state got the info from UPS. I don't know what to believe, but I sure hope someone gets a big group of us together to do something to stop this outrage!!! We smokers have become quite an easy target - - - and now they're using tax money (their salaries!!) researching who is buying what from where!!!!!

When I first heard a rumor this was going on I found Wisconson was getting info from UPS and I switched to ordering from a Swiss outfit that used USPS, states can't tell them what to do.
They messed that up when they started seizing shipments from overseas it seems to have involved ATF since federal taxes weren't paid on the imports but then it is argued it is up to customs to collect the import tax.

Even if UPS didn't roll on you all they had to do is supeona the records since you were dealing with esmokes a domestic operation in Tenn or Kentucky.


I don't know how this will all play out when all they have is what was seized, these Swiss companies claim info cannot be released per Swiss law even at the request of a foreign government, I guess we will see what is fact or fiction, until then it is low profile and MYO for me.

Esmokes was required to send the info to your states. I've been saying that on here for almost 2 years now. All they need is a few states complaining to the federal govt about the Jenkins act, and a federal judge will issue an order requiring them to disclose info or go to jail and be punished really badly. E-smokes doesn't care about their customers' privacy that much. You may talk to some guys from KY now that say they won't give out your information, but when the federal govt comes down on them, I'm sure they will. Listen to me next time. There are 4 safe ways to get tax free (low tax) cigarettes now. The Russian option's gonna be the first to go, so enjoy it now.

I,m afraid you are pretty much right, the Russian smokes have to make it through customs now, so I think that could be considered hit or miss and I don't think we know yet how those misses will come back to get us yet.

Looks like the fallout is coming state by state, hoping to see a list here of stores involved in providing lists.

One sure bet is everyone who received a tax bill from NYC should be expecting a bill from NYS next and I,m sure NJ won't be far behind with their huge budget crisis.

I ordered from a Va store a couple years back, not even sure how many cartons, maybe 15-20, stopped that when I heard of Jenkins act and switched to Swiss store, the Va. store was not a super bargain but reasonable for domestic Marlboros with miles, about $25 a carton UPS included. The Native American sites seem to be much higher, the Swiss site I have ordered from sendcigarettes.com has converted to native american and is now $35 for a carton of Marlboro up from $20, well over what I am willing to pay.

Guys, you might want to read my posts in the "Cigarette Tax" thread. I just got a tax bill from New Jersey, with two separate line items listed: (1) Excise tax for $1600, and (2) Sales/use tax for $240.

It's my contention that, since I purchased my cigarettes from cigoutlets.com (shipped from Richmond, VA) via the Internet, and since VA excise tax was paid at the time of purchase (as indicated by the VA revenue stamps on the packs), that the excise tax portion of the bill constitutes a "multiple tax" (as defined by the Internet Tax Freedom Act of 1998, and subsequent federal statutes), and, as such, is a violation of that federal law. I am considering checking into this as to possible litigation. This tax seems wrong. Maybe ACLU can help us.
