Prevent All Cigarette Trafficking Act of 2009 or PACT Act - Amends the Jenkins Act to: (1) include smokeless tobacco as a regulated substance; (2) impose shipping and recordkeeping requirements on delivery sellers (sellers using the telephone, mails, or the Internet) of cigarettes and smokeless tobacco; (3) require common carriers of cigarette products to obtain age and identity verification upon delivery of such products; (4) require the Attorney General to compile and publish a list of delivery sellers of cigarettes or smokeless tobacco who have not complied with the registration or other requirements of such Act; (5) increase criminal penalties and impose new civil penalties for violations of this Act; and (6) grant jurisdiction to U.S. district courts to prevent and restrain violations of this Act and direct the Attorney General to administer and enforce this Act.

Amends the federal criminal code to: (1) treat cigarettes and smokeless tobacco as nonmailable and prohibit such items from being deposited in or carried through the U.S. mails; and (2) authorize officers of the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) to enter the premises of certain cigarette shippers to inspect records and inventories.

I wonder if this Act applies to Indian reservations. It looks like that would be a giant loophole in the legislation that would really benefit the reservations, as they would be the only ones still allowed to ship cigs through the mail.

Good question, libertarian! I was ordering from an Indian reservation, because they disallowed them to sell a certain brand in my state and bordering states. Does anyone know?

If I understand correctly, you will still be allowed to buy from indian reservations, but you will have to pay local and state taxes.

But are not indian reservations supposed to be free from the local and state taxes? If they try that, i will just DRIVE Onto them and buy in person.

I was thinking about driving there in person, too, but I don't think there are any reservations close to Indiana. I actually have a family member who is married to a Navajo Indian. They live in Arizona. I think his family still lives on the reservation. But this wouldn't be a family member that I would feel comfortable asking for help getting cigs.

Another thing I thought about doing was taking a long road trip through the states that have the lowest taxes, buying cigs at various outlet stores along the way. Some of the states have dramatically lower taxes. You can find a map that shows all the tax rates here.

Unfortunately, my car is not dependable enough for a long road trip. I would probably end up paying for a major car repair, which would cancel all my cig tax savings.

What's the deal with the Indian cigarette brands, anyway? I've never tried any. Are they cheaper?
