If an online tobacco shop accepts credit cards, that shop will report orders (as a smoking activist from my state told me).
Is this true that simply accepting credit cards for payments means the shop reports orders? If that's the case, I hope that MYO shop I bought from a while online (stuffyourown.com) won't report MY orders since I used a credit card! |

Taxes
All Federal and Georgia tobacco and tube excise taxes are pre-paid and included in our prices. Consumers are responsible for reporting and paying any State/Local taxes that may be due.

Online and Mail Order Cigarette sellers are required by law to report their out of state sales.....HOWEVER
Stuff Your Own.com does not sell cigarettes or cigars, and therefore is not required by the "Jenkins Act" to report ANY of our out of state sales.
Since you're buying tobacco rather than pre-made cigarettes it looks like maybe you're okay here.
I would strongly suspect reporting to state tax men from any USA online seller who sells cigarettes and accepts credit cards. Not so regarding overseas sellers of cigarettes.
Credit card or not I'd be leery of USA online sales of any tobacco product and for that matter of any mail order from anywhere. You don't know all that's going on. They're out to get us and they're out to get the sellers. Cash at a discount shop within a reasonable distance is the best way to go. Watch for spotters too. They are doing that in some places.
I suspect you are okay but it's always best to play smart and keep safe. |

I was under the impression that the catch was "if you used a credit card" ----
My local supplier has gone up 4 times in the last year 50% No telling where it will go if they override the Bush veto
Do you know if the law is federal or Ga.?

Jay, at this time Illinois has not enacted a tax on supplies ( bulk T or Tubes )
So for the current, other than the obligatory sales tax you are sliding on, you are safe.
For pre-mades, DO NOT TRUST ANYPLACE.
I used to trust the Swiss, but no longer.... |

Please correct me if I'm wrong, but....
From my research online, when a state charges back taxes for premade cigs bought online, they focus on the quantity of cigs bought on the invoices, NOT the amount of money the smoker paid for them.
Now I know when you buy cartons OFFLINE, when you look at a receipt, it doesn't say "Newport 100's Box Carton." It just says the name of the brand, and the qty number of the brand is usually 10 to indicate 10 packs (and 10 packs is the same as one carton).
Now, I learned when states request orders, the shop has to send them invoices of all of the customers' orders. Me examined an invoice I found from a shop in my room dated from earlia this year.
If this invoice I'm seeing right now is an example of the same invoices IL tax authorities would see if they request my orders from that shop....and if it's true they don't care about how much I spent but they focus more on the QTY listed on each invoice, then here's an interesting Q.
State of IL send back tax forms if I buy at least one full carton in one order (10 packs). But this invoice only has 2 under "Quantity" It doesn't say 20....just the numba 2. Would I have to file back taxes on 2 packs (although I know what that 2 actually represents)?
Filing back taxes on 2 packs is a joke, but a lot more affordaable than 20 packs. If IL ever sees my invoices form this shop, they'll think the shop sold me 1-5 packs at a time. LOL
Even if they guessed that 2 unda "QTY" on my invoice represents 2 cartons I bought online, they wouldn't know how many packs are in each carton from that invoice. According to my understanding, some brands have cartons with less than 10 packs in them. |

The most I'll ordered on-line is Machines and small amounts of different tubes to try out.
And they'll probably find a way to tag me for those too.

What about those who use e-check, since e-check is the more common form of payment within all online tobacco shops?
That MYO shop I bought from in the past (stuffyourown.com) only uses credit/debit cards for payment.
I don't use a credit card anyway. I know if the states only cared about how much I spent at a shop, they can just read my bank statement for that. They wouldn't need to see invoices. I was told they need to see how many packs I bought (on the invoices) in order to file back taxes.

They might have listed quantity by carton. I would bet the gov would assume that, and you'd still get stuck with the tax on twenty packs.
